Advanced Telesensors (“ATS”) Products
(a) ATS hereby warrants solely to End User that the ATS Products will not contain any defects in material or workmanship that cause such ATS Product to fail to function in any material respect when properly operated (the “Product Warranty”) for a period of twelve (12) months from the date of purchase (the “Warranty Period”) by End User.
(b) Customer's sole remedy for a breach of the Product Warranty shall be the repair or replacement of the of the non-functioning ATS Product to ATS. Customer shall obtain from ATS a Returned Goods (“RG”) number before returning any such ATS Product (as described below under “How to Make a Claim Under this Limited Warranty”).
(c) If such ATS Product is not functioning within the scope of the Product Warranty, ATS shall, at ATS's sole option, (i) repair or replace such ATS Product within twenty (20) business days of ATS's receipt thereof. ATS shall be responsible for the shipping costs associated with transporting the repaired or replaced ATS Product to End User. or (ii) use reasonable diligent efforts to provide End User with a correction or workaround of the defect.
(d) The ATS Product that was repaired or replaced under the Product Warranty is guaranteed for ninety (90) days from the repair or replacement date, or the remainder of the Warranty Period, whichever is longer.
(e) In the event that ATS determines, using customary testing procedures, that the returned ATS Product is functioning within the scope of the Product Warranty, then ATS shall not be responsible for the repair or replacement of such ATS Product and End User shall be responsible for the shipping costs of the return of such ATS Product to End User or its designee.
(f) Notwithstanding any of the foregoing, the ATS Product Warranty does not extend to (i) non-conformities, defects or errors in the ATS Product due to accident, abuse, misuse or negligent use of the ATS Products or use in other than a normal and customary manner, (ii) environmental conditions not conforming to ATS’s product specification, or failure to follow prescribed installation, operating and maintenance procedures, (iii) lightning, power surges, or other acts of nature, (iv) equipment enclosures, cables or accessories used in conjunction with this product, (v) exposure to excess moisture, (vi) fire, (vii) improper packing and shipping (such claims must be presented to the carrier), (viii) defects, errors or nonconformity's in the ATS Product due to modifications, alterations, additions or changes not made by ATS or authorized by ATS in writing, (ix) normal wear and tear, (x) damage caused by force of nature or act of any third person, or (xi) service or repair of the ATS Product not made by ATS or authorized by ATS in writing.
(a) A limited software warranty is provided with the ATS Software provided to End User by ATS. For a period of ninety (90) days from date of purchase by End User, ATS warrants that the ATS Software will conform to ATS's published specifications in all material respects on date of purchase when properly operated in accordance with the specifications and documentation.
(b) Defects in the ATS Software will be reported to ATS accompanied by supporting information reasonably requested by ATS to verify, diagnose, and correct the defect. ATS's exclusive obligation and liability with respect to any nonconforming ATS Software shall be, at ATS's option, (a) to replace that copy of the Software with one that conforms to the specifications, or, (b) to use reasonable diligent efforts to provide the End User with a correction or workaround of the defect. ATS is under no obligation to provide software updates, which contain additional features and enhancements other than defect corrections.
How to Make a Claim Under this Limited Warranty
To make a claim under this Limited Warranty, contact Advanced TeleSensors by email or telephone in accordance with Technical Support below with the following information:
ATS Product name and model
ATS Product serial number
Original purchase date with original receipt
Company/Distributor name and location
Name of contact person for description of symptoms
A description of the failure to function and other reasonable information to enable verification of the failure and return of the nonconforming ATS Product to ATS's designated facility
Return shipping address and any special instructions
If it is determined that the ATS Product must be returned under this limited warranty, a RG number, obtained from ATS, will be required. Any returned ATS Product must be properly packed to prevent damage in transit. Boxes not bearing a RG number will require additional processing time and repair service may be delayed. End User shall be responsible for all shipping costs to ATS’s designated facility.
